By accessing or using the NirtsCAD Service, you agree to these CAD application terms. If you do not agree, do not use the Service.
1. The Service
NirtsCAD is a browser-based CAD application and related functionality we may offer (including optional features such as Google Sign-In and an AI assistant). Features may be rolled out or updated over time.
The Service is not sold as a long-term hosted drawing repository unless we clearly offer that as a separate product and update these NirtsCAD terms of use. Unless we say otherwise, you are responsible for saving and exporting your work to your own systems.
2. Eligibility and accounts
You must be legally able to enter a binding agreement in your jurisdiction and meet any minimum age we specify in our privacy notice.
If Google Sign-In is enabled, your use of Google authentication is also subject to Google’s applicable terms and policies. You are responsible for maintaining the security of your Google account.
3. Your responsibilities
You agree that you will:
Use the Service only for lawful purposes and in compliance with these CAD application terms and applicable law.
Not misuse the Service (including probing, disrupting, overloading, scraping in violation of our rules, attempting unauthorized access, or interfering with other users).
Not upload or transmit malware or unlawful content through the Service.
Maintain backups of important work. Browser-based software can be affected by connectivity, device issues, or updates.
You are responsible for decisions you make based on outputs from the Service, including any AI-assisted outputs (see Section 7).
4. Your content (CAD data) and license to operate the Service
Your drawings and related CAD data remain yours. Niroobini does not claim ownership of your CAD content.
To the extent necessary for us to provide, operate, secure, and improve the Service (for example processing data in memory on servers or devices as part of a feature you invoke), you grant us a limited, non-exclusive, worldwide, royalty-free license to use, host, process, transmit, display, and store that content solely for those purposes, and only as long as needed for those purposes unless a longer period is required by law.
If you export or save content locally, you are responsible for how you store and share it afterward.
5. AI assistant; third-party AI; API keys
If the Service includes an AI assistant, it may rely on third-party AI providers (for example Google Gemini / Google AI). Your use of those providers may be governed by their terms, policies, and usage rules.
You may be asked to provide an API key so the assistant can run. As described in our Privacy Notice, we may store your API key on our servers in encrypted form to enable the feature. You are responsible for the security and validity of keys you supply, for any charges incurred with the AI provider, and for compliance with the provider’s rules.
No professional advice. AI outputs may be incorrect, incomplete, or unsafe for your project. The Service is not a substitute for professional engineering, architecture, code compliance, or safety review. You remain responsible for your designs, calculations, compliance with standards, and fitness for purpose.
6. Intellectual property — NirtsCAD software
The Service, including its software, branding, documentation, and related materials, is owned by Niroobini or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these NirtsCAD terms of use, no rights are granted to you.
You may not reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits.
7. Third-party services
The Service may integrate or interoperate with third-party services (for example Google Sign-In, Google Cloud, Google AI). Those services are provided by third parties and may be subject to additional terms. We are not responsible for third-party services beyond what the law requires.
8. Beta / phased features
Certain features (including Google Sign-In and the AI assistant) may be released in phases. We may change, suspend, or discontinue features with reasonable notice where practicable.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
NIROOBINI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
NIROOBINI’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to you only to the extent permitted.
11. Indemnity
To the maximum extent permitted by law, you will defend and indemnify Niroobini and its directors, officers, employees, and contractors against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your content; (c) your violation of these CAD application terms or applicable law; or (d) your dispute with a third party (including an AI provider).
12. Suspension and termination
We may suspend or terminate access to the Service if we reasonably believe you violated these terms, pose a security risk, or must do so to comply with the law.
You may stop using the Service at any time. Provisions that by their nature should survive (including Sections 4 (as to accrued rights), 6, 9–12, 14–16) survive termination.
13. Changes to these Terms
We may modify these CAD application terms by posting an updated version at https://nirts.in/terms-of-use-nirtscad and updating the Effective date. If a change is material, we may provide additional notice where required by law or through the Service. Continued use after the effective date of changes constitutes acceptance unless applicable law requires otherwise.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles, subject to mandatory consumer protections in your jurisdiction.
You agree that the courts in Chennai, Tamil Nadu, India will have exclusive jurisdiction, subject to mandatory provisions of applicable law.
(If you want arbitration instead of courts, replace this section with counsel-approved arbitration language.)
15. Export and sanctions
You represent that you are not prohibited from using the Service under applicable export control or sanctions laws. You may not use the Service in violation of those laws.
16. Miscellaneous
Entire agreement. These CAD application terms, together with the Privacy Notice linked above, are the entire agreement between you and Niroobini regarding the Service, subject to any separate written agreement you sign with us.
Assignment. We may assign these terms in connection with a merger, acquisition, or sale of assets. You may not assign without our consent.
No waiver. Failure to enforce a provision is not a waiver.
Severability. If a provision is invalid, the remainder remains in effect.
